1. Purpose of this Privacy Policy

The purpose of this Privacy Policy is to inform you about the means we employ to collect your personal data, in accordance with your rights. We inform you that, for the collection and management of your personal data, we comply with Law No. 78-17 of January 6, 1978, relating to information technology, files, and freedoms, in its current version (hereinafter referred to as “The Data Protection Act”) and Regulation (EU) 2016/679 of April 27, 2016, concerning the protection of individuals with regard to the processing of personal data and the free movement of such data (hereinafter referred to as the “GDPR”). This Privacy Policy also concerns the rights of reproduction and the regulation on the use of hyperlinks on the website eye-motion.fr and the E(ye) Motion software.

2. Identity of the data collection controller

The controller of the collection of your personal data is the company E(YE) MOTION, a simplified joint-stock company, registered with the Trade and Companies Register of Toulouse under the number SIREN 822316436, with its registered office located at 18 Rue du Général Giraud, 31200 Toulouse.

3. Definition and nature of personal data

When visiting the website eye-motion.fr or downloading the E(ye) Motion App from Google Play Store or the App Store, we may request that you provide certain of your personal data so that you can correspond with us or use the services offered by E(YE) MOTION. In the context of this Privacy Policy, the term “personal data” is used to refer to any data that can identify an individual, such as your name, first name, gender, postal and email addresses, phone numbers, profession, and any other information you may provide. E(YE) MOTION reserves the right to create an anonymized user database. This database allows E(ye) Motion to collect user data for the purpose of improving its services and collecting patient data to feed reference values for statistical samples. In the event that E(YE) MOTION decides to establish such a database, it undertakes to inform users in advance by email at least one (1) month before its implementation. Users can then, if they wish, provide their express consent. In the absence of the user’s express consent, E(ye) Motion will not collect the data of that user to populate its database. Users have the option to give their consent at any time by sending an email to E(ye) Motion at the address contact@eyemotion.fr.

4. Collection of personal data

Your personal data is collected for one or more of the following reasons:

  1. Manage your access to and use of certain services available on the E(YE) MOTION application,
  2. Perform operations related to customer management (contracts, orders, invoices, customer relationship management),
  3. Maintain a customer database,
  4. Develop business and usage statistics,
  5. Manage unpaid amounts and potential disputes related to the use of our products and services,
  6. Customize responses to your information requests,
  7. Comply with our legal and regulatory obligations.

During the collection of your personal data, we will inform you of mandatory and optional data. Mandatory data is necessary for the operation of the services. As for optional data, you are entirely free to fill them in or not. We will also inform you of possible consequences if you do not fill in optional data.

5. Recipients of the collected data

Your personal data will be accessible to authorized personnel and control bodies (e.g., auditors). Your personal data may also be transmitted to public bodies such as judicial auxiliaries, ministry officials, and debt recovery agencies, exclusively for the purpose of complying with our legal obligations.

6. Retention periods for personal data

Regarding customer and prospect management data:

Your personal data is retained for the period strictly necessary for the management of our business relationship with you.

In the case of potential market prospecting, your data may be retained for a period of 3 (three) years from the end of the business relationship.

Data related to the proof of a right or a contract, which must be retained to fulfill a legal obligation, will be kept for the period prescribed by the current law.

Personal data related to a prospect who is not a customer may be retained for a period of 3 (three) years from their collection or the last contact with the prospect. After this 3 (three)-year period, we may reach out to you to inquire if you wish to continue receiving commercial solicitations.

As for patient profile data:

If the user has accepted the collection of their patient data in the anonymized database of E(YE) MOTION, this data will be retained for a duration of 5 (five) years from the date of collection.

Regarding the management of opposition lists for receiving prospecting:

Information related to the exercise of your right to object is retained for at least 3 (three) years after the exercise of the right to object.

Upon the expiration of the necessary retention period, the data will be anonymized and kept exclusively for statistical purposes, without being used for commercial exploitation.

Audience measurement statistics and raw traffic data are not retained for more than thirteen (13) months.

7. Security

We inform you that we take all appropriate organizational and technical measures to preserve the security, integrity, and confidentiality of your personal data, including preventing them from being distorted, damaged, or accessed by unauthorized third parties. We also use secure payment systems that comply with industry standards and applicable regulations. We adhere to the security measures implemented by Scaleway, which is our health data host.

8. Hosting

We inform you that your data and that of users are stored on servers owned by the company Scaleway, located in France, for the duration of their storage. The data of residents of the European Union and the United Kingdom will not be transferred outside the European Union as part of the services we offer. Your data and that of your patients may be stored locally on the internal memory of your device. In this case, E(YE) MOTION disclaims any responsibility for the user’s use of data stored locally.

9. Access to your personal data

In accordance with the Data Protection Act No. 78-17 of January 6, 1978, and the GDPR, you have the right to obtain the transmission and, if necessary, the rectification or erasure of data concerning you by contacting:

Persons whose data is collected based on our legitimate interest, as mentioned in Article 4, are reminded that they can oppose the processing of their personal data at any time. However, we may continue processing if there are legitimate reasons for processing that override your rights and freedoms, or if processing is necessary to establish, exercise, or defend our rights in court.

10. Right to define directives regarding data processing after death

You have the right to define instructions regarding the storage, erasure, and disclosure of your personal data after your death. These instructions can be general, meaning they apply to all your personal data. In this case, they must be registered with a digital trust service certified by the CNIL. Instructions can also be specific to the data processed by our company. You must send them to the following coordinates:

By sending us such instructions, you expressly consent to the storage, transmission, and implementation of these instructions in accordance with the rules outlined in this document. When you have passed away, this person will be qualified to access these instructions and request their implementation. If you do not designate a person, your heirs will be qualified to access these instructions and request their implementation. You can modify or revoke your instructions at any time by writing to the coordinates above.

11. Portability of your personal data

You have the right to data portability, which applies to data that you have actively and consciously provided in the context of accessing and using the services, as well as data generated by your activity in using the services. This right does not apply to data collected and processed on a legal basis other than consent or the execution of the contract between us. You can exercise this right free of charge at any time, especially when closing your account on the Application, in order to retrieve and store your personal data. In this context, we will provide your personal data, by any means considered useful, in a standard open format commonly used and machine-readable, in accordance with the state of the art.

12. Filing a complaint with a supervisory authority

You are also informed that you have the right to file a complaint with the competent supervisory authority (for example, in France, the National Commission for Information Technology and Liberties) in the member state of your habitual residence, your place of work, or the place where your rights were violated, if you believe that the processing of your personal data covered by this Privacy Policy constitutes a violation of applicable laws. Such a complaint can be made without prejudice to any other action before an administrative or judicial court. You also have the right to an effective administrative or judicial remedy if you believe that the processing of your personal data covered by this Privacy Policy violates the applicable law.

13. Limitation of processing

You have the right to obtain a limitation of the processing of your personal data in the following cases:

  • During the verification period we implement when you contest the accuracy of your personal data,
  • When the processing of this data is illegal, and you prefer to limit the processing instead of deleting your data,
  • When we no longer need your personal data, but you wish to retain them to exercise your rights,
  • During the verification period of legitimate reasons when you object to the processing of your personal data.

14. Changes

We reserve the right, at our sole discretion, to modify this Privacy Policy at any time, in whole or in part. You will be informed of these changes by email if we have your email address. Otherwise, you will be informed when downloading the Application after the new Privacy Policy comes into effect. These changes will take effect from the date of publication of the new Privacy Policy. Your visits to the website eye-motion.fr and your use of the E(YE) MOTION application after the entry into force of these changes will be considered as an acknowledgment and acceptance of the new Privacy Policy. If you do not agree, and if the new Privacy Policy does not suit you, you should no longer access the application.

15. Reproduction rights

Written and/or published by the editors of the site eye-motion.fr, these contents may not be reproduced freely without indicating the source. Likewise, deep linking is prohibited, meaning that the pages of the site eye-motion.fr should not be embedded within the pages of another site.

16. Hyperlinks

The site eye-motion.fr allows any website or other media to quote it or establish a hyperlink pointing to its content. The authorization to set up a link is valid for any media, except those that disseminate information of a polemical, pornographic, xenophobic nature, or that may, to a greater extent, offend the sensibilities of the majority.
